In five current decisions the Supreme Court has confirmed (most recently OGH 9 Ob 20 / 21p) that the Austrian gaming law is compatible with the law of the European Union and that players from European online gaming providers (all except win2day) can claim their losses back.
The highest courts under public law (Administrative Court and Constitutional Court) also confirmed the Austrian Gaming Act as compliant with the European law (VwGH June 8th, 2021, Ra 2020/17/0096 and VfGH February 28, 2020 (G 286/2019-6)).
Now even the European Court of Justice (ECJ) has confirmed with its decision of May 18, 2021 in the case C-920/19 Fluctus and Fluentum that even excessive advertising by win2day does not necessarily lead to the Austrian Gaming Act being in breach of European law.
In Austria only win2day has an Austrian gaming license. All providers from the European Union offer their online gambling illegally in Austria. Maltese gaming licenses are not sufficient in Austria. This means that machine, roulette, blackjack and poker losses can be reclaimed because the gambling contracts are illegal.
Thus, the legal situation has currently been clarified by all three Austrian Supreme Courts. The players of illegal online casinos can claim their losses back due to a lack of an Austrian license.

Ich traute der ganzen Sache nicht, bis ich des Besseren belehrt wurde.
